TENANCY AGREEMENT

Introduction

THIS AGREEMENT between the following parties ;

  1. Tenant and
  2. Safe Hold Legacy Homes , a legal entity registered in the Republic of Uganda of Sumbwe Bulenga as the registered OWNER (Hereinafter referred to as the Rental Property Owner/Apartment Manager) of piece / parcel of land and House erected thereon Known as Premises.

Property Description

This Agreement pertains to the fully furnished residential property located at Sumbwe Bulega, comprising Fully furnished one bedroom apartments , including shared units with two bedrooms.

NOW IT IS HEREBY AGREED AS FOLLOWS: -

  1. Terms of Agreement: Commencement Date
  2. The term of this Agreement is for three months, commencing on;
    1. Start Date: and automatically terminates on
    2. End Date:.
  3. Termination & Termination Notice
    1. The Tenant will be required to issue the Rental Property Owner at least two weeks' notice of termination;
    2. This Agreement shall terminate at the end of the specified term. Early termination may occur only if both parties agree in writing, or in case of breach of this Agreement by either party;
    3. Extension of tenancy will be on mutual agreement upon sole determination of the rental Property Owner.
  4. Rental Fees
    The Tenant(s) shall occupy the premises on a rent-free basis for the duration of this Agreement.

THE TENANT HEREBY COVENANTS WITH THE Rental Property Owner AS FOLLOWS: -

(TENANT’S OBLIGATIONS)

The Tenant hereby agrees to adhere to the following terms and conditions upon admission into the premise and Immediately as per the agreement: -

  1. The Tenant(s) agrees to use the property solely for residential purposes and Tenant like manner for a private residential dwelling only and shall not carry on or permit to be carried on any trade or business of any kind whatsoever (or otherwise agreed) ;
  2. At all times during the term, keep the interior of the said property in good repair and condition, fair wear and tear expected, and to yield up the same in good repair and condition at the expiration of the said term;
  3. The Tenant(s) is responsible for their own personal security and must ensure that no doors are left open upon departure during the tenancy and occupancy period;
  4. The Tenant(s) agrees to keep the unit and the household safe at all times;
  5. Adhere to the code of conduct requiring no sexual activity, consumption of alcohol, use of drugs, or parties are allowed in the apartments during the occupancy period;
  6. All tenants must return to the house by 10:00 PM each evening unless previously arranged otherwise with the Apartment Manager;
  7. Tenants must inform the Rental Property Owner if they intend to be away from the property for more than three days.
  8. The Tenant(s) agrees not to remove any household items, furniture, or other provided amenities from the premises upon departure or at any other time during the tenancy.
  9. Furthermore, the Tenant shall maintain the compound in a manner that is satisfactory to the Rental Property Owner’s requirement;
  10. Permit the Rental Property Owners at all reasonable times upon written notice to enter the property to view the state and condition thereof and the fixtures, fittings and furniture therein (if any);
  11. Make periodic inspection of the property and report immediately in writing to the Rental Property Owner of any apparent defects, which may develop in the structure of the premise, any signs of white ants, bees, termites or any destructive insects or any wet or dry rot.
  12. Not to assign, sublet or part with possession of the property (or any part thereof), without previous consent in writing of the Rental Property Owner.
  13. Not to do or suffer to be done on the property anything which may be or become a nuisance or annoyance to the Rental Property Owner or the Tenant or occupiers of any adjoining premises or which may vilitate the insurance of the property against fire or otherwise, or increase the ordinary premium for such insurance.
  14. The Tenant agrees to disclose any relationships with individuals who may benefit directly or indirectly from the tenancy agreement, wherein the Tenant's rent is waived. This disclosure must be made in writing (Including text message) to the rental Property Owner prior to the execution of this Agreement and updated as changes occur. Failure to disclose such relationships may lead to termination of the Agreement at the Rental Property Owner’s discretion.
  15. Responsibilities in Shared Units
    1. A duty roster for cooking and other communal activities may be established in shared units;
    2. The Tenant agrees that no form of sexual exploitation, sexual abuse, or sexual harassment shall occur at or in connection with the Premises. Sexual exploitation includes any actual or attempted abuse of a position of vulnerability, differential power, or trust for sexual purposes, including, but not limited to, profiting monetarily, socially, or politically from the sexual exploitation of another. Violation of this provision shall be considered a serious breach of this Agreement and will result in immediate termination of the tenancy and possible legal action.

RENTAL PROPERTY OWNER OBLIGATIONS

THE RENTAL PROPERTY OWNER HEREBY AGREES WITH THE TENANT AS FOLLOWS:

  1. All utilities and services required for the premises shall be provided by the Rental Property Owner for the duration of this Agreement;
  2. The Rental Property Owner shall be responsible for all maintenance and repairs needed to keep the premises in a habitable condition. The Tenant(s) shall promptly notify the Rental Property Owner of any needed repairs;
  3. To keep the main walls, roof and main structures of the premises in good order;
  4. To insure and keep insured the building forming part of the premises against loss or damage by fire and other usual risks.
  5. To be responsible for electrical wiring and electrical apparatus comprising and forming part of the electrical circuit of the property, and to make good and promptly and defects or default discovered in the same premises (structural defect only).

PROVIDED ALWAYS AND IT IS HEREBY EXPRESSLY AGREED BY AND BETWEEN PARTIES HERETO AS FOLLOWS: -

Alterations

  1. No alterations, installations, or modifications shall be made to the premises by the Tenant(s) without prior written consent from the Rental Property Owner;
  2. Not to damage or injure the property or make alterations or addition to it (including boundary and fences) and shall not cut any timber or remove any trees or shrubs without the prior consent of the Rental Property Owner (if any).

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Uganda.

Indemnity

The Tenant agrees to indemnify and hold harmless the Rental Property Owner and its agents from any claims arising from the Tenant's use of the Premises, except for claims due to the Landlord's gross negligence or willful misconduct. This indemnity shall survive the termination of the lease.
